El Registro General Sanitario de Empresas Alimentarias y Alimentos (RGSEAA) tiene como finalidad la protección de la salud pública y de los intereses de los consumidores. Además, gracias a este, existe un control oficial de todas las empresas dedicadas a actividades alimentarias.

Una vez que se ha realizado la solicitud, el número correspondiente del Registro Sanitario, emitido por el Ministerio de Salud, tarda entre 2 y 3 meses. Sin embargo, aproximadamente 4 días después del trámite se consigue un justificante. Con este ya se puede iniciar la actividad comercial. A excepción de aquellas empresas que están en contacto directo con animales.
El registro también puede ser denegado si tras la inspección de sanidad previa e imprescindible, se emite un informe desfavorable. En este caso, la empresa tendrá un plazo de 3 meses prorrogables para las modificaciones.

1º. Que la sede del establecimiento o si no existe establecimiento la sede o domicilio social, esté en territorio español.

2º. Que la empresa tenga por actividad:

Alimentos o productos alimenticios destinados al consumo humano.
Materiales y objetos destinados a estar en contacto con alimentos.
Coadyuvantes tecnológicos utilizados para la elaboración de los alimentos.

3º. Que realice alguna de las siguientes actuaciones:

producción, transformación, elaboración y/o envasado,
almacenamiento y/o distribución y/o transporte,
importación de productos de otros países no pertenecientes a la Unión Europea.

1. Establecimientos que venden al consumidor final in situ, de carácter permanente o no, fijos o móviles, y las empresas titulares de los mismos. Solo deberá inscribirse si las ventas al consumidor final dejan de ser marginales y locales.
2. Actividad comercial entre establecimientos de comercio al por menor. Aquí incluimos los restaurantes y similares, pero no los caterings, que si deben estar inscritos.
3. Establecimientos que preparan, venden y sirven para su consumo en los mismos y las empresas titulares de estos.

• Si la compañía quiere distribuir productos alimenticios a otros países deberá solicitar un número como distribuidor.
• Si una industria solicita un número de registro sanitario como fabricante, elaborador y/o transformador, envasador y/o almacenista, podrá distribuir sus productos sin necesidad de tener la actividad de distribuidor.
• En caso de comercializar y distribuir productos de un país miembro de la Unión Europea (UE) en territorio nacional, solicitará su inscripción como distribuidor.
• Las empresas importadoras y distribuidoras, si tienen almacén solicitarán también su inscripción como almacenista.

Estábamos en una reunión de equipo por la mañana cuando nos entró una llamada de gran urgencia. Se trataba de un empresario que importa en España shakers.

Su empresa había gastado una gran cantidad de dinero para transportar unos shakers a España desde otro país. Sin embargo, al llegar a las aduanas le avisaron de que si no entregaba el registro adecuado, todas las unidades se quedaban inmovilizadas en aduanas con un coste elevadísimo por día por tener allí retenida la mercancía. Dicho producto sería destruido.

Dados los daños que iba a tener la empresa, reorganizamos a todo el equipo y ese mismo día nuestro equipo de consultoría le remitió precio de los procedimientos a llevar a cabo y este los pagó al instante conseguimos darle a la empresa el papel que necesitaba y que le pedía en aduanas para desbloquearlo todo. En el mismo día por la tarde, la empresa pudo desbloquear toda la mercancía y no tener ningún daño o coste adicional. Gracias a ello, procedimos al trámite del alta en el registro e inmediatamente se le enviaron los justificantes correspondientes al cliente.

Caso 2 – emergencia en la aduana

Muchos años importando bolsas de plástico cuando decides como empresa poner en la bolsa por primera vez “este producto puede entrar en contacto con alimentos”. Algo que parece sencillo y normal sin ninguna implicación.

Sin embargo, aduanas consideró que si las bolsas podrían entrar en contacto con alimentos, la empresa debería tener el Registro Sanitario. Al llegar toda la mercancía a aduanas como siempre, el empresario se encontró con la sorpresa que se quedaba todo en aduanas retenido abonando los costes tan elevados que ello implica por la retención de la mercancía.

Nos llamó y en dos horas le conseguimos el documento que necesitaba para que aduanas le desbloqueara toda la mercancía y pudiera seguir comercializando las bolsas como llevaba haciéndolos tantos años.
