Amazon warns about Extended Producer Responsibility
Starting in 2022, if you sell products in Germany or France, Amazon will require you to add your extended producer responsibility number to the appropriate fulfillment portal in Seller Central.
Extended Producer Responsibility (EPR) transfers to manufacturers the cost of managing the waste generated by the products they place on the market.
It is a concept coined within the European Union policy that is summarized with the “polluter pays” principle. The aim is to ensure that no damage is caused to the environment through proper waste management, but without the cost being passed on to the administration and to citizens who do not consume the product.
What do I have to do?
If you sell a product subject to extended producer responsibility requirements in France, Germany or both, you have to register with the relevant implementing agency or with the relevant national authority. Producer Responsibility Organization (PRO) and provide Amazon with the policy registration numbers corresponding to the product as proof of compliance.
What if I cannot demonstrate to Amazon that I meet the extended liability requirements?
If you cannot demonstrate that you meet the requirements, in the case of Germany, Amazon will be legally obliged to suspend those listings that do not meet the requirements. For France if you sell applicable APR products on Amazon.fr to customers with a shipping address in France, Amazon will by default pay the applicable green contributions to the relevant Product Responsibility Organizations on your behalf.
There are other important aspects to consider in addition to registering with the relevant implementing agency or Producer Responsibility Organization in France or Germany. You have to declare your sales (of products covered by the different extended producer responsibility product categories) and pay ecological contributions to the respective producer responsibility organizations during the respective declaration period.
