EUDR Guide 2025\u20132026"},"content":{"rendered":"<p>The E<strong>uropean Union&#8217;s regulation on deforestation-free products (EUDR) requires that certain products<\/strong> can only be placed on the EU market or exported if they are <strong>deforestation-free,<\/strong> have been produced in accordance with the law of the country of origin, and have a <strong>due diligence declaration<\/strong>.<\/p>\n<p>In this guide, we will explain, clearly and step by step, what will be required of you and what you must do to comply with the regulations. It affects anyone who places covered raw materials or their derived products, such as food supplements, on the <strong>EU market <\/strong>or <strong>exports<\/strong> them. This includes operators (those who introduce them for the first time) and traders (those who make them available afterwards).  <\/p>\n<p>This affects you if your company uses the following raw materials or manufactures certain products from them: <strong>cattle, cocoa, coffee, oil palm, rubber, soybeans, and timber.<\/strong><\/p>\n<h3>2) Key implementation dates<\/h3>\n<\/section>\n<section id=\"fechas\">Although the effective date is 2026, we recommend starting to gather the necessary information to be able to declare <strong>products deforestation-free<\/strong>, avoiding last-minute problems. Make a note of these dates: <\/p>\n<ul>\n<li><strong>Large and medium-sized <\/strong>enterprises: application from <strong>30 December 2025<\/strong>.<\/li>\n<li><strong>Micro and small <\/strong>enterprises: applicable from<strong> 30 June 2026<\/strong>.<\/li>\n<\/ul>\n<\/section>\n<section id=\"que-pediran\">\n<h3>3) What they will ask you for (customers, marketplaces, and customs)<\/h3>\n<p>This will enable you to prove that your products are truly<strong> deforestation-free i<\/strong>n accordance with regulations.<\/p>\n<ol>\n<li><strong>Due diligence declaration (DDD) <\/strong>submitted to the official EU system <em>before<\/em> placing the product on the market or exporting it. This DDD generates a reference number. <\/li>\n<li><strong>DDD reference number<\/strong> to link it to the customs operation and, where applicable, to B2B orders and marketplaces. Your customers may ask you for it. <\/li>\n<li><strong>Geolocation of the plots<\/strong> where the raw material was produced:\n<ul>\n<li>Plots larger than 4 ha (except for cattle): industrial estates.<\/li>\n<li>Plots of up to 4 hectares: point or polygon.<\/li>\n<li>Cattle: point of each establishment through which the animal passed.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Production dates <\/strong>and <strong>legality checks<\/strong> in the country of origin (land use rights, permits, etc.). You must keep the documentation for 5 years. <\/li>\n<li><strong>Risk assessment <\/strong>(by country, area, mixture, traceability, etc.) and, where appropriate, mitigation measures to ensure zero or negligible risk.<\/li>\n<\/ol>\n<h3>4) How to prepare yourself. Do you meet all these requirements? <\/h3>\n<\/section>\n<p>To ensure that your next import or sale can be declared as <strong>deforestation-free products<\/strong>, here is a series of requirements that your company must meet. Do you meet them all? <\/p>\n<p><strong>A. Define the scope<\/strong><\/p>\n<ul>\n<li>Make an <strong>inventory<\/strong> of affected products and ingredients (tariff codes\/CN).<\/li>\n<li>Confirm your <strong>role<\/strong> (operator or trader) as this determines your obligations.<\/li>\n<\/ul>\n<p><strong>B. Request critical data from suppliers now<\/strong><\/p>\n<ul>\n<li><strong>Geolocation<\/strong> of plots (polygons or points, as applicable).<\/li>\n<li>Production\/harvest <strong>dates<\/strong> or ranges.<\/li>\n<li><strong>Proof of legality<\/strong> (titles, permits, licences).<\/li>\n<li>Avoid <strong>mixtures<\/strong> of unknown origin: if you cannot separate them, the batch may be considered non-compliant.<\/li>\n<\/ul>\n<p><strong>C. Set up your Due Diligence System (DDS)<\/strong><\/p>\n<ul>\n<li>Register with the<strong> EUDR Information System<\/strong> and define who creates and signs each DDD.<\/li>\n<li>Standardise your <strong>risk assessment.<\/strong><\/li>\n<li>Keep all documentation for <strong>5 years<\/strong>.<\/li>\n<\/ul>\n<p><strong>D. Connect with your daily operations<\/strong><\/p>\n<ul>\n<li>Integrate the <strong>DDD number i<\/strong>nto your ERP and share it with logistics, customs, and B2B customers.<\/li>\n<li>Include <strong>EUDR clauses <\/strong>in purchase contracts: data obligation, audits, and segregation.<\/li>\n<li>Train in purchasing, quality and supply chain in the new flows.<\/li>\n<\/ul>\n<h3>5) If you sell on marketplaces (Amazon, etc.)<\/h3>\n<p>The EUDR applies to \u2018placing on the market\u2019, even if you sell on marketplaces. Many buyers and platforms are requesting the DDD number and evidence of traceability. That is why it is essential to anticipate and be able to certify products as deforestation-free. Some of the penalties you may incur are:  <\/p>\n<ul>\n<li><strong>Relevant<\/strong> fines (based on turnover in the EU).<\/li>\n<li><strong>Confiscation<\/strong> of goods and income and bans on selling.<\/li>\n<li>Temporary <strong>restrictions<\/strong> on access to public procurement or financing.<\/li>\n<\/ul>\n<h3>7) Product-specific exemptions<\/h3>\n<\/section>\n<p>The EUDR provides for <strong data-start=\"14\" data-end=\"61\">specific exemptions by product type <\/strong>(or cases outside its scope) that should be reflected in this article.<\/p>\n<p>Waste and products <strong data-start=\"148\" data-end=\"237\">recovered or manufactured entirely from recycled material<\/strong> (e.g., wood from demolition or items made from by-products) are excluded, but this exemption does not extend to by-products from processes that use material that is not waste.<\/p>\n<p>Used or <strong data-start=\"465\" data-end=\"503\">second-hand products<\/strong> and <strong data-start=\"510\" data-end=\"534\">product samples <\/strong>of negligible value and quantity intended for testing, analysis or approval are also excluded, as are packaging used<strong data-start=\"651\" data-end=\"707\"> exclusively to hold<\/strong>, <strong data-start=\"628\" data-end=\"640\">protect<\/strong> or transport another product (pallets, boxes, wrappings) and ancillary materials such as <strong data-start=\"779\" data-end=\"803\">manuals or catalogues<\/strong>, provided they do not contain relevant raw materials.<\/p>\n<p>Furthermore, the Commission&#8217;s guidelines clarify that only products actually manufactured with a <strong data-start=\"944\" data-end=\"1006\">\u201crelevant raw material\u201d<\/strong> listed in Annex I are subject to the rules (the prefix <strong data-start=\"1044\" data-end=\"1052\">\u201cex\u201d <\/strong>is added to several codes to avoid including items without such raw materials).<\/p>\n<p>Finally, in the timber and rubber sector, it has been confirmed that <strong data-start=\"1191\" data-end=\"1208\">bamboo and rattan <\/strong>are excluded and that not all <strong data-start=\"1252\" data-end=\"1273\">natural rubbers<\/strong> other than <em data-start=\"1287\" data-end=\"1307\">Hevea brasiliensis<\/em> are covered. These exclusions and clarifications \u2014 included in the Commission&#8217;s guide and documents and disseminated by sectoral advisers \u2014 are also being communicated by marketplaces. <\/p>\n<p>In the specific case of <a href=\"https:\/\/sellercentral.amazon.es\/help\/hub\/reference\/external\/GU6MAG9H6WCAG2UV?locale=es-ES\" target=\"_blank\" rel=\"noopener\">Amazon, its internal regulations<\/a> state that products may be exempt from providing a reference and verification number if they meet any of the following conditions:<\/p>\n<ul>\n<li data-start=\"272\" data-end=\"385\"><strong data-start=\"272\" data-end=\"306\">100% recycled raw material<\/strong>: all relevant raw materials in the product are fully recycled.<\/li>\n<li data-start=\"387\" data-end=\"485\"><strong data-start=\"387\" data-end=\"408\">Harvest date<\/strong>: all relevant raw materials were harvested <strong data-start=\"460\" data-end=\"484\">before 29\/06\/2023.<\/strong><\/li>\n<li data-start=\"487\" data-end=\"627\"><strong data-start=\"487\" data-end=\"536\">Marketing of raw materials in the EU<\/strong>: all relevant raw materials were marketed in the EU <strong data-start=\"602\" data-end=\"626\">before 30\/12\/2025.<\/strong><\/li>\n<li data-start=\"629\" data-end=\"735\"><strong data-start=\"629\" data-end=\"672\">Marketing of the product in the EU<\/strong>: the product was marketed in the EU <strong data-start=\"710\" data-end=\"734\">before 30\/12\/2025.<\/strong><\/li>\n<li data-start=\"737\" data-end=\"824\"><strong data-start=\"737\" data-end=\"775\">Product manufacturing date<\/strong>: the product was manufactured <strong data-start=\"799\" data-end=\"823\">before 29\/06\/2023.<\/strong><\/li>\n<\/ul>\n<p>If batches of products were marketed in the EU before the date of entry into force of the Regulation, they may be exempt under the above points, although Amazon itself is likely to contact sellers to confirm the dates of manufacture.<\/p>\n<p>&nbsp;<\/p>\n<p>At <a href=\"https:\/\/legalegoabogados.com\/\" target=\"_blank\" rel=\"noopener\">LegaleGo Legal Services<\/a>, our colleagues have prepared a detailed analysis of the legal framework governing EUDRs.
