
Modification of the Terms of Use for the New Food Product “Oleoresin Rich in Astaxanthin from the Haematococcus pluvialis Alga”
On August 1, 2023, the European Commission published Implementing Regulation (EU) 2023/1581, amending the previous regulation that applies the new conditions of use for the new food product “Oleoresin Rich in Astaxanthin from the Haematococcus pluvialis Alga.”
Astaxanthin is a member of the carotenoid family, with the most well-known ones being beta-carotene, lycopene, and lutein, and they are commonly found in living organisms.
Because of this, all plants synthesize them because they play an important role during photosynthesis, facilitating a reaction that uses light and carbon dioxide to produce organic compounds and oxygen.
With this new Regulation, which came into effect on August 22, 2023, the use of the new food product is expanded to include dietary supplements, with the following maximum astaxanthin levels:
- Children aged 3 to 10: 2.3 mg
- Adolescents aged 10 to 14: 5.7 mg
- General population aged over 14: 8 mg
As stated in the Regulation, additional specific labeling requirements are also included.
“The denomination of the new food product on the labeling of food products containing it shall be ‘Oleoresin Rich in Astaxanthin from the Haematococcus pluvialis Alga.'”
The labeling of dietary supplements containing oleoresin rich in astaxanthin from the Haematococcus pluvialis alga shall include a declaration that these dietary supplements should not be consumed:
- a) If other dietary supplements containing astaxanthin esters are consumed on the same day
- b) By infants and children under 3 years of age
- c) By infants and children under 10 years of age*
- d) By infants, children, and adolescents under 14 years of age*
* Depending on the age group for which the dietary supplement is intended”
