
Amazon warns about extended producer responsibility
From 2022, if you sell products in Germany or France, Amazon will require you to add your Extended Producer Responsibility number to the relevant compliance portal in Seller Central.
Extended Producer Responsibility (EPR) shifts to manufacturers the cost of managing the waste that will be generated by the products they put on the market.
It is a concept coined within the policy of the European Union that is summarised by the “polluter pays” principle. The aim is to ensure that no damage is caused to the environment through proper waste management, but without the cost being passed on to the administration and to citizens who do not consume the product.
What do I have to do?
If you sell a product subject to the requirements of the ERP in France, Germany or both countries, you must register with the relevant enforcement body or Producer Responsibility Organisation (PRO) and provide Amazon with the product’s policy registration numbers as proof of compliance.
What if I cannot prove to Amazon that I meet the extended producer responsibility requirements?
If you cannot demonstrate that you comply with the requirements, in the case of Germany, Amazon will be legally obliged to suspend those listings that do not comply with the requirements. For France, if you sell RAP-applicable products on Amazon.fr to customers with a shipping address in France, Amazon will by default pay the relevant green contributions to the relevant Product Responsibility Organisations on your behalf.
In addition to registering with the relevant implementing body or Producer Responsibility Organisation in France or Germany, you have to declare your sales (of products covered by the different Extended Producer Responsibility product categories) and pay ecological contributions to the respective Producer Responsibility Organisations during the respective declaration period.
